Improving The Procedure For Drafting And Formalizing Documents In Internal Affairs Bodies

Abstract: Today, in our country, many reforms are being implemented in internal affairs bodies to improve the procedure of drawing up and formalizing documents. In the international experience, the concept and system of improving the procedure for drafting and formalizing documents in internal affairs bodies is one of the controversial discussions.

Introduction

With the Decree of the President of the Republic of Uzbekistan dated October 3, 2019 “On measures to fundamentally improve the personnel policy and state civil service system in the Republic of Uzbekistan” No. PF-5843, the ground was prepared for fundamental reforms in the civil service. For the first time in the history of Uzbekistan, the state civil service and the state special service were mentioned separately in a legislative document.

Clause 1, paragraph 4 of the Decree stipulates that military service in the Armed Forces of the Republic of Uzbekistan and service in law enforcement bodies is considered a special service of the state and is regulated by separate legal documents. Based on the requirements of the decree, the draft law “On State Civil Service” was developed. Article 4 of the project defines the state civil service as “remunerated professional activity of citizens of the Republic of Uzbekistan for the public interest in state bodies and organizations.” However, there is still no normative legal definition or project on what is meant by the special state service, including the service of law enforcement agencies, and which agencies are included in the system of these agencies.

Although the term “law enforcement agencies” is widely used in jurisprudence and legislation, there are only some doctrinal definitions of the term “law enforcement agencies” in our country.

According to M.H. Rustambayev, U.A. Tokhtasheva, law enforcement agencies perform the main task of protecting the legality and law enforcement, protecting the rights, freedoms and legal interests of citizens, labor unions, society and the state, as well as fighting against crime. special authorized bodies.

F.K. Rakhimov, M.B. Goipov stated that law enforcement bodies are created to protect the legal system of the state and perform the main functions in the field of law enforcement. Law enforcement agencies, along with protecting the legal order in the country, perform the tasks of identifying and combating crimes and violations.

Yu.A. Lukichev notes that the concept of “law enforcement agencies” is still a topic of discussion in modern legal literature, which causes a number of disputes. The scientist said that some legal scholars add the legal profession to the system of law enforcement agencies. Some consider law enforcement agencies as special type of state agencies with coercive influence.

This situation may require taking measures to optimize the functions and powers of supervisory and law enforcement bodies. Accordingly, it is appropriate to create a single body for state financial control and combating economic crimes.

It can be organized in the form of financial police based on the experience of Kazakhstan, Belarus or Ukraine.

In addition, at the moment, the legislation of Uzbekistan does not have a single normative legal document that defines the general directions of the activities of law enforcement agencies, but the Strategy of Actions on the five priority directions of the development of the Republic of Uzbekistan in 2017/2021 Clause 62 of the state program for implementation in the “Year of supporting active entrepreneurship, innovative ideas and technologies” (2018) provides for measures aimed at ensuring legality and justice in the activities of law enforcement agencies “Law Enforcement The task of developing the draft law of the Republic of Uzbekistan “On bodies” is set. However, there is no public information on the current state of affairs in this regard. The lack of uniform legislation can cause various misunderstandings in the understanding of law enforcement activities and the tasks of the bodies engaged in this.

CONCLUSION

In conclusion, while developing the new concept of administrative reforms of Uzbekistan, it will be appropriate to carry out work on optimizing the system of law enforcement bodies as part of the existing state apparatus. This can serve to further improve the existing system and ensure compliance with international standards.
