Kisii High Court has upheld Nyaribari Masaba MP Daniel Manduku Win over insufficient evidence.
Laban Chweya, Elijah Moindi, Benard Ondari petitioners filed a case at Kisii Law Court challenging the win of Manduku.
The petitioners said that the exercise was unfair and wanted the exercise to be nullified.
The petitioners also asked the court to allow scrutiny and recount of ballot boxes in the constituency over allegations raised by witnesses during cross examination.
During the cross examination High Court Judge in Kisii Hedwig Ong’udi dismissed the re-tallying and scrutiny of 33 ballot boxes in an election petition challenging the win of Nyaribari Masaba Member of Parliament Daniel Manduku
Former Nyaribari Masaba Member of Parliament Elijah Moindi garnered 4,482 votes while Benard Ondari garnered 5,366 votes, the two filed the petition challenging Manduku’s win(ODM) who had 16,303 votes.
Manduku was declared a winner by Independent Electoral Boundaries Commission (IEBC).
Ong’udi dismissed the petition and ordered the petitioners to pay costs amounting to Ksh 20million.
Manduku called upon all his opponents to work together for better development of the constituency.
“Time for politicking is over, let us now dwells on more important issues,”he said.
He vowed to the electorates that he will serve them and bring more development as he pledged during the campaign.
