Three Accused persons linked to gouging of baby Sagini’s eyes to be Remanded at Kisii Main Prisons

Alex Maina Ochogo, Rael Nyakerario and Pacificah Nyakerario accused persons have been charged with unlawfully attempted murder contrary to section 220(a) of the penal code.
The accused persons are alleged that they gouged Baby Sagini’s eyes on 13/12/2022 &14/12/2923 at Ikuruma Village, Marani sub county Kisii County.
The boy was found abandoned in a maize farm and rushed to hospital.
According to the prosecutor Hillary Kaino he asked the court to deny the accused persons bail on the grounds that there is luckily hood of them to interfere with the witnesses and prejudice the matter before the Court.
The prosecutor also stated that since the matter is in public interest and they are so aggrieved they might cause harm to the accused persons.
He also cited that if they will be released the community will live in fear, insecure and being intimidated.
“Those are the compelling reasons as to why the accused persons not to be granted cash bail or Bond,”said Kaino.
Alex Maina and Rael Nyakerario supported the application while Pacificah Nyakerario denied the application.
Baby Sagini’s Lawyers, George Morara holding brief for Attorney General, Daphine Biyaki and Anita Nduhukire supported the prosecutor’s application and said that Baby Sagini is wellbeing attended by the medics and he is well improving.
Senior Resident Magistrate Christine Ogweno said that the Court considers the safety of the accused persons and they will not allow them to be back to the same environment where the public are aggrieved.
Also the witnesses will be subjected to fear anxiety and intimidation.
The court ruled that the accused persons to be remanded at Kisii Main Prison and they are free to make application on bond or bail in future.
Mentioning of the case will be on 18/1/2023.
