Committee On Lands Engages With National Lands Commission On Delmonte Land Dispute

A Parliamentary Committee has directed the National Land Commission (NLC) to halt all activities and actions related to the Del Monte Ltd land matter until the land dispute is resolved.
The National Assembly vommittee on Lands, chaired by North Mungirango MP Joash Nyamoko, recently held a meeting with NLC chairman Gershom Otachi, Commissioner Tia Galgalo and Ms. Kabale Tache Arero, CEO of the NLC regarding the implementation status of directives issued by the committee on Lands and the committee on Implementation in the 12th Parliament concerning the Del Monte Ltd land issue.
The meeting centered on the failure by the NLC to implement recommendations made by two committees of the National Assembly
The 12th Parliament, committee on Lands had recommended that the NLC investigate the circumstances surrounding the irregular acquisition of the surrendered land parcels by Del Monte Kenya Limited.
Members of the committee noted the conflicting submissions by NLC regarding the registration of the lease held by the firm.
In their submissions, Otachi claimed that the land parcels was formed through the amalgamation of several surrendered land parcels.
However, Lawmakers raised questions regarding the total acreage of the disputed land, the specific parcels in Kiambu and Muranga counties, and the accuracy of a previous survey conducted. Committee Members expressed confusion over the number of parcels leased out to Del Monte and those surrendered to the County Governments.
Regarding the renewal of leases and the status in allocating Kandara residents their land, the NLC Chair clarified that they had not received any requests related to the land from the County Governments of Kiambu and Murang’a, nor were they aware of any recent letters requesting lease renewals.
The representatives of the NLC were put to task on their commitment to resolve the historical land dispute with members of the committee inquiring about the action the Commission has taken to ensure the land dispute was resolved
Legislators also raised alarm over about activities taking place on the land despite court orders.
Following the meeting, the committee on Lands intends to hold discussions with the County Governments of Kiambu and Muranga, as well as the Ministry of Lands and the NLC.
The 12th Parliament had recommended that after the expired lease, the land should revert back to being public land and be allocated to the Kandara Residents Association and other beneficiaries.
The proposed allocation was 70% to the beneficiaries and 30% to the County Governments of Muranga and Kiambu.
