Kitutu Chache South Member of Parliament Anthony Kibagendi was released on a Sh200,000 bond with a surety of a similar amount, or an alternative cash bail of Sh100,000.
He was arraigned before the Narok Law Courts and charged with assault.
Mr Kibagendi, a first-time lawmaker, was accused of assaulting Astarico Omariba Moriasi on November 27, 2025, at Java House in Kisii Township, thereby occasioning him actual bodily harm.
He faces a second count of willfully and unlawfully damaging a mobile phone, an iPhone Pro Max valued at Sh230,000, belonging to Mr Omariba.
In a third charge, the MP is accused of willfully and unlawfully damaging one brown chair, four plates and one cup, all valued at Sh20,000, property of Java House.
Kibagendi appeared before Narok Resident Magistrate Ester Mwikali Mutuku, where he denied all charges.
The court released him on a Sh200,000 bond with a surety of a similar amount, or an alternative cash bail of Sh100,000.
The case was initially filed in Kisii Law Courts before being transferred to Narok. Earlier, the accused had been granted a Sh50,000 bond.
The defence team, led by Kisii Senator Okong’o Omogeni, raised concerns over the alleged misuse of public resources, claiming they were taken in circles while tracing their client. The team also decried alleged harassment by state operatives.
The case is scheduled to resume for hearing on March 2.
Following Mr Kibagendi’s arrest, Jubilee presidential candidate Dr Fred Matiang’i, who hails from the Gusii region, condemned the treatment of the lawmaker, terming it “shameful behavior” on the part of the government.
There were also spontaneous protests in parts of Kisii and Nyamira counties, with residents condemning the arrest and terming it a political witch-hunt.
Speaking to journalists in Nairobi, Dr Matiang’i alleged that the arrest was a scheme by the government to silence his supporters.
“What has happened to Kibagendi since yesterday is very shameful behavior on the part of the government. I am restraining myself from expressing extreme disgust at what is happening decades after independence,” Dr Matiang’i said.
He further alleged that over the past two months, the government has been offering Kisii leaders jobs in parastatals and money in a bid to lure them away from Jubilee and distance them from him.
“We are in a political competition, and democracy, especially multi-party democracy, is a reality in this country. Those who want to campaign with me in Jubilee should be left free,” said Dr Matiang’i, who is also the Jubilee Deputy Party Leader.
He claimed that pressure being exerted on leaders from the Gusii region was targeted at intimidating him and his allies, adding that he would soon publicly address allegations of senior regional leaders being contacted at night and offered inducements.
“We expect much more decency, conduct and discipline from this government. Politics should be practiced in a decent, responsible and respectful manner. The law must apply to both the opposition and those in government,” he said.
Dr Matiang’i urged his supporters to remain calm, patient and law-abiding, but warned that rising public agitation could escalate if the situation persists.
“We want a stable country and to move forward. But if confrontation is the path they choose, we will walk it. No government wins when it moves against its people in the primitive manner we are witnessing,” he said.
