Two residents in Kisii have today filed a petition in court challenging the victory of the Kisii Woman Rep Dorice Donya Aburi.
The two petitioners Ezekiel Okenye and Job Nyabuto filed their joint petition against the Independent Electoral Boundaries Commission (IEBC), Kisii County Returning officer Michael Kosgei and the Kisii county Woman Rep Dorice Donya Aburi.
In the last elections,Dorice Aburi garnered (Wiper) 190,277 votes against former Woman Rep Janet Ongera(ODM) 69,995,Teresa Bitutu(UDA) 40,972, Rachel Otundo( 31,575 and ten others.
The petitioners are challenging Donya’s victory on the grounds of voter bribery, intimidation of former woman member of the national assembly Janet Ong’era’s supporters and coordinated violence from Donya and Kisii country governor Simba Arati’s supporters.
“The petitioners are aggrieved the results and contends that the elections was not conducted in free fair, verifiable and accurate and credible manner, “read the report.
The petitioners argue, Ong’era’s agents and others were denied entry to the polling station which is a crucial significance for a free fair and credible elections.
“Some of the ballot boxes from Nyamisaro primary school were not sealed during the time of delivery at Nyamache, constituency tally center, “read a section of the petition.
The petitioners says that several chief agents complained to the presiding officers and the police officers based at the polling stations, however no action was taken to address the same.
They further argues that there were unreasonable and unaccounted delay in the transportation of the ballot boxes from Nysamisaro primary school polling station, raising questions as to the credibility and verification of the results.
They also say that there was willful, deliberate criminal tampering and manipulation of the results of the Kisii county woman member of the national assembly.
In Kisii south constituency, two candidates have petitioned court to overturn Anthony Kibagendi victory in Kitutu Chache South poll in Kisii on the grounds of massive irregularities rendering the entire exercise gross, fatally defective and defeating the very purpose of the country’s electoral process.
The petition by Andrew Maubi (Wiper) and Kenani Omwando (Independent) on 7/9/2022 challenged the Electoral process which handed victory to Anthony Kibagendi .
Kibagendi was declared the victor with 14,478 votes against his closest challengers Andrew Maubi 10,378, Eric Abuga 4,131 and Omwando ran an independent and secured 3,471 votes.
In Nyaribari Masaba constituency they have also petitioned the victory of Daniel Manduku.
