Twenty Seven Released on Cash Bail for Illegally Participating Saba Saba Demonstration

Twenty Seven Accused persons have been arraigned in Kisii Law court for conducting unlawful protests during Saba Saba protests in Kisii town.
The accused persons appeared before Senior Principal Magistrate Caroline Ocharo were charged with that on 7th July they conducted unlawful protests within the streets of Kisii town.
The protesters were arrested during Saba Saba anti _government demonstration where they were protesting against the high cost of living and the Controversial Finance Act, 2023.
Five of the accused persons were also charged with malicious damage of property of a government vehicle where they destroyed windscreen and headlights.
Also 12 of the accused persons were also charged with malicious damage for destroying a windscreen and headlights to a government vehicle Ksh.50,000 in Kisii town.
Further, the 12 were charged for destroying window panes belonging to Kenya Commercial Bank worth Sh.500,000.
The accused persons pleaded not guilty to the charges.
Zelmer Bonuke representing the accused persons applied for a free bond for since almost all the accused were students from colleges and universities within Kisii.
“The accused are not flight risk as they would avail themselves to court when needed,” said Bonuke.
Bonuke argued, his clients have been in custody since Friday and some were injured during the arrest.
“My clients were on the streets minding their own business,” said Bonuke.
George Morara counsel said among the arrest was a minor and he should be released on a free bond.
Prosecution counsel James Morande said defense counsel never proved to court on those who were sick and also never provided evidence to court whether there was a minor.
“I pray for objection to this application and ask this court to give the accused persons reasonable bond terms,” said Morande.
The court ruled, considering the circumstances of the case and most of them are students they should be given reasonable bond terms.
The Court granted each of accused persons a cash bail of KSh.30,000 apart from the minor.
Mentioning of the case will be on July 24th and hearing 30th October.
