The Directorate of Criminal Investigations (DCI) has commenced investigations over land scandal of a property worth Sh80 Million in Ruaka, Kiambaa Sub-County, Kiambu County.
This is after a section of the late Munyui Gathwira family recorded statements at the Kiambu Police Station with the DCI where their land registered as LR Kiambaa/Ruaka 618 measuring 0.510 acres was transferred illegaly by one of their kin and later sold to Gitari Gachoki who is the Kirinyaga Central Member Of Parliament.
The suspect ,Wagacha Munyui, fraudulently removed his brother David Ngigi munyui as a co_administrator by filing forged documents in Kiambu Court and had the properry registerd in his name,all in a record one day and without the consent of the rest of the family members.
The alleged fraud was only discovered by the family five years later when the MP invited them for a meeting and indicated that he was interested in purchasing the land. When they conducted search on the property at the land office they were shocked to discover it was registered as Wagacha’s. Vide a letter dated 20th April 2023 by brothers Peter, Kamau, David Ngigi, Fredrick Mburu, Steph Ndungu and Stephen Mungai they required the Kihara Assistant County Commissioner, Eldwin Ongeto issue restrictions on any transactions on the land stating that one John wagacha had illegally registered LR Kiambaa/Ruaka 618 under his name and was in the process of selling the same.

He has denied claims of grabbing land and says he fulfilled all the requirements when acquiring the land.
Part of the Munyui family had accused the legislator of conspiring with some of the family members to deprive others of their inheritance land.
Fredrick Mburu,one of the aggrieved,speaking during an interview said that the legislator must have been aware that this was family land which explains why he gave some family members cheques of sh 200,000 each promising to pay them more when the deal was concluded.
“If he was buying the property as registered, why did he issue 3 cheques worth 200,000 Shillings each to some of our brothers?” posed Mburu. He claims that the cash was meant to hoodwink them and stop them from pursuing justice once the fraud was discovered.
“The sale of our land was facilitated after our brother filed documents claiming that we were all deceased.” he said.
David Ngigi, during an interview after recording statement with the DCI ,said that he was duped by his brother Wagacha and made to sign documents not knowing that he was transferring his administrators powers to him.
“None of my other brothers as listed beneficiaries was present in court when I was presented as having consented to leaving a singular administrator. At the time,I was not even aware of what I was agreeing to”, he said
The family members claimed that corrupt dealings were undertaken with land officials in Kiambu lands registry where they were issued fake death certificates of family members who are still alive.
“Corrupt administration officials in Kiambu facilitated this egregious act by accepting fraudulent death certificates of family members who are still alive. We are shocked and appalled by this blatant corruption,. Even more dishearteningis the action of Deputy Commissioner. Maina who obviously helped complete this fraudulentdeed” they said.
The green card shows that 5 years before the day the office of the DCC helped with the transfer of the property, in 2018, the court had directed that the 2 brothers jointly get registered as administrators in relation to the property that was the subject of an application to amend a grant.
