A Kwale court has sentenced Evans Oganda Ogega to 20 years in prison for the defilement of a 15-year-old schoolgirl.
The offence occurred on September 8, 2021, in Mwaoni area, Diani location, Kwale County.
Kwale Resident Magistrate Ruth Ogolla ruled that the evidence presented by the prosecution, which included Allen Mulama, Wangari Mwaura, Nandi Rosemary, and Collins Orwa, was compelling and irrefutable. Five prosecution witnesses provided consistent and corroborative testimonies, leading to a conviction.
The court was informed that Ogega ambushed the victim as she entered her family house to fetch water while her mother was outside.
He forcibly assaulted her, silencing her with a cloth to prevent her from screaming.
The court further heard that concerned by the delay, the mother went to find out what was happening only to discover the accused leaving the premises and found her daughter in distress, with her school skirt stained.
The mother notified neighbors, who responded with anger. A swift police intervention prevented the mob from harming Ogega. The officers managed to calm the crowd and safely transported Ogega, who had locked himself in his house for fear of being attacked, to Diani police station, where he was charged with defilement.
When he was placed on his defence, Ogega argued that he was falsely accused and framed by the victim’s family.
Despite his claims of innocence and his plea for acquittal, Ogolla determined that the prosecution had successfully proven the critical elements of the case: the victim’s age, the occurrence of penetration, and the accurate identification of Ogega as the perpetrator.
