A security firm and its director have sued the Kingdom Bank demanding more than KSh500 million for arrest, confinement, and unlawful prosecution that it allegedly instigated.
Jonah Waweru Kamau and his firm, Lions Security Limited have move to court seeking compensation after the bank withdrew a criminal case he was facing for issuing cheques that were not honoured to his payees.
In Court papers, Kamau avers that under the instructions of the said bank, police officers stormed his firm’s Nyeri town office on February 13, 2020 where they arrested him and detained him at the local police station. He was denied bail pending arraignment which happened the following day.
Before Chief Magistrate M. Kagendo, he denied all the eight charges levelled against him and was ordered to deposit a surety of Sh200,000 so that the case could proceed while he was out of the custody.
However, he says that he was unable to have the bond processed, making him to spend four nights at GK Prison in King’ong’o near Nyeri town.
At the prison, he says, he was forced to share a room with persons who had committed various felonies, much to his distraught.
The case was allocated Senior Principal Magistrate F. Muguongo who was to try him.
However, he says, the bank which was the complainant sought to withdraw the matter even before it took off where the bank’s Nyeri branch Relationship Officer Dennis Kamau Akunja presented in court a letter stating that the financial institution had no interest in pursuing the matter further.
The letter that was also copied to the Central Bank’s Anti-Fraud Unit was signed by the bank’s Head of Legal Services at the bank, Jack Kimathi.
With that development, the trial court acquitted the businessman on October 26, 2021.
With the case behind him, Kamau moved to the High Court seeking compensation for various losses that he says were prompted by his arrest, detention and prosecution.
Him alongside his firm filed the matter on January 19 last year before Justice Martin Muya.
In his affidavit before the High Court, which was drawn by lawyer Kamau Nyagah who is based in Kitengela, the businessman and his firm are jointly seeking various prayers.
First, he want the court to declare that his arrest, detainment and prosecution.

They are also seeking damages for emotional and moral frustrations, general damages and expectations damages.
Other forms of damages being sought include restitution and punitive as well as the cost of the suit plus interests.
The case is expected to kick off on May 17th.
