Small Claims Courts Mark Two Years Since Inception

The Court Users Committee celebrated two years of operationalization, sensitization and achievement of the Small Claims court.
In Nyeri, an open day was held at Nyeri Law Courts after a procession around the town where residents were sensitized on the purpose of the court which has jurisdiction over civil claims whose subject matter does not exceed Sh1 million.
Evelyne Gaithuma, an adjudicator in- charge of Nyeri noted that the main objective of the court is to enhance access to and expeditious delivery of justice through simplicity of procedures, timely disposal of cases, fairness of process and affordable court fees.
The court deals with civil claims relating to contract for sale and supply of goods and services, contract relating to money held and received, liability in tort in respect to loss or damage of any property,Β compensation for personal injuries claims and set βoff and counterclaim under any contract.
Since March last year, 513 cases initiated in Nyeri, 447 cases were resolved and only 66 are pending. Over Kshs. 83 Million has been collected by the court which has been ploughed back part to the economy.
Stella Kanyiri who is the national Acting Registrar in charge of small courts said most of the cases are determined within 45 days. Others take 60 days.
Many of the cases were filed at a nominal fee of not more than Sh1,000.
Nyeri Chief Magistrate Alfred Kibiru said the aim of the small claims court is to dispense justice in a fair, timely, simple, affordable and accessible manner, enhance the ease of doing business in the country and uphold the rule of law.
The Magistrate said the court is committed to efficient, accessible, and accountable service delivery while protecting the rights of all especially the vulnerable.
The court is guided by the core values which include integrity, professionalism, efficiency, diligence and accessibility.
