The Ethics and Anti-Corruption Commission (EACC) has arrested Nyamira County Assembly Clerk Duke Simeon Onyari over allegations of corruption and the loss of KSh 30 million linked to the construction of the Nyamira County Assembly office block.
According to EACC investigations, the alleged irregularities stem from the award of a construction tender to Jetta Builders Limited in contravention of procurement laws. Investigators established that the company was awarded the contract despite not being the lowest evaluated bidder, resulting in what the commission describes as an unlawful benefit of approximately KSh 30 million.
Speaking to the press at the EACC South Nyanza Regional Office, Regional Manager Alfred Mwachugha said the commission received reports alleging irregular procurement practices in the award of the tender for the construction of the assembly office block.
“Investigations established that the County Assembly of Nyamira awarded the tender to Jetta Builders Limited, which was not the lowest evaluated bidder. This amounted to the conferring of a benefit of about KSh 30 million to the contractor,” said Mwachugha.
Following the completion of investigations, the EACC forwarded its findings to the Office of the Director of Public Prosecutions (ODPP), which approved charges against several officials connected to the project.

Those facing charges include Duke Simeon Onyari, Clerk of the Nyamira County Assembly; Leonard Kevin Nyamasege, Deputy Clerk and Director of Finance and Accounts; David Nyarango Ombego, Deputy Clerk and Director of Legal Services; Joyce Oyengo, Director of Monitoring, Evaluation and Development; Engineer Joseph Martini-Oruru, Chief Officer for Roads and Public Works in the Nyamira County Government; Eric Onguti Ayuka, Infrastructure Officer; and Simon Ondari Ogecha, Infrastructure Officer.
Mwachugha revealed that one of the suspects was arrested on March 19 and arraigned before a Nyamira court in a case titled Republic versus Duke Simeon Onyari and Seven Others.
He further noted that the original tender for the construction of the Nyamira County Assembly offices was valued at approximately KSh 367 million.
“Today, we managed to arrest the clerk, who has been on the run. The suspects have been moving to various courts seeking anticipatory orders in an attempt to avoid the court process. However, we have successfully apprehended him and are currently processing him for arraignment in court tomorrow,” said Mwachugha.
The EACC has also urged the remaining suspects who are yet to be arrested to surrender to the commission for processing and subsequent arraignment in court.
The commission says investigations are ongoing and that additional suspects linked to the alleged procurement irregularities could be pursued as the case progresses.
