The Ethics and Anti-Corruption Commission (EACC) has advised a family in Kiambu county to report a land fraud involving an 8-acre parcel of land allegedly grabbed by a government administrator to the Directorate of Criminal Investigation (DCI) in a view of seeking legal redress.
According to documents presented the land number Karai/Ruthigiti/1037 which is in Kikuyu subcounty originally belongs to the late Joseph Kioi acquired in 1975 which was to be occupied by his 10 children.
Lawrence Nganga the son to Kioi during an interview said that they were shocked to find the graves of their parents flattened and one of their brother’s property demolished and were being evicted by the authorities from the land as the land did not belong to them.
“We were shocked to be evicted from a land we knew belonged to our family for many years,” he said.
He said they were further shocked to find out that the land was registered at the land’s office on 14th June 2020 to other persons who include Freshiah Wairimu Gutu, Njoroge Mungai and Esther Mwihaki to hold trust for themselves and others who are not known to them.
The family presented documentation to the EACC of the progress of the land of how the original owner of the land late Joseph Kioi applied to be allocated the open space by the then county council of Kiambu and was granted.

“This office has noted that despite being allocated five-acre land at Nguirubi (Parcel No. Nguirubi/Thigio/125) you are still occupying a portion of Karai/Ruthigiti/1037.
Please note that T. 1037 is earmarked for those who did not benefit with allocation of five-acre land.
you are therefore required to vacate the plot T. 10370 with immediate effect,” wrote P.T Wanyugi county.
Wairimu did not heed to the notice and was later summoned to district officer Kikuyu.
Kioi sought representation of Muhuhu and company advocates after the late Kenneth Kamumbu the then councillor of Nachu ward where the land is located wrote to him accusing him of trespass in his land and had removed building stones and other materials.
Humphrey Muchogia, one of the sons to Kioi said that their land has been evicted and has suffered through being arrested and jailed.
“In 2010 when my father died I was arrested by the assistant chief for defying orders that our father should not be buried in the land. Police officers came and I was arrested and charged with assault and jailed in Ruiru,” he said.
Lucy Wanjiru daughter to Kioi said that the reason why their land has attracted grabbers is that the county government has not issued them with a title deed and it has not been fenced off.
“Those who have evicted us are usurping their powers and threatening us telling us there is nothing we can do to them. I have been arrested and jailed in Langata over the land,” she said.
Paul Mwangi, a human rights activist, said that many less privileged people have been suffering from being robbed of their properties by grabbers using their positions in government to threaten and intimidate them.
“This matter is a clear indication of persons in government misusing their offices and powers to grab land from people who are poor,” he said.
He said that he has since written to EACC, DCI, Ministry of lands over the matter where EACC has replied and has given advice that the matter be taken up by DCI.
