Obado, Barchok, Wairia among former and current officials facing crucial week in anti-graft courts

A sitting governor, two former county bosses and a former deputy governor as well as senior public officials and politicians are set for a decisive week in court as the Ethics and Anti-Corruption Commission (EACC) pushes ahead with high-profile corruption, forgery and abuse of office cases across the country.

Bomet Governor Hillary Kipng’eno Barchok and two others are expected in court tomorrow Thursday where they are facing charges of conflict of interest, acquisition of proceeds of crime and money laundering.

The EACC alleges that the governor improperly received Sh2.8 million from companies that conducted business with the county government.

At the centre of the proceedings is former Migori Governor Zacharia Okoth Obado and seven others, whose judgement is scheduled for Friday at the Milimani Anti-Corruption Court.

The accused are facing charges of conspiracy to commit corruption offences, conflict of interest, money laundering and unlawful acquisition of public property linked to the alleged misappropriation of KSh73.5 million between 2013 and 2017.

According to the EACC, the funds were allegedly siphoned through proxies associated with the former governor.

Another eagerly awaited judgement will be delivered tomorrow at the Kerugoya Law Courts involving Kirinyaga Deputy Governor Peter Ndambiri Njagi and two others accused of conflict of interest.

The prosecution alleges that the former deputy governor abused his office in the award of a road construction tender to Jestam Enterprises Limited.

Also awaiting judgement tomorrow are Joshua Munyaka and Daniel Kilonzi at the Anti-Corruption Court in Kitui.

The two are charged with using false and misleading documents in connection with the alleged irregular award of a KSh35 million tender for the supply, delivery and commissioning of drilling rig sets by the Kitui County Government during the 2013/2014 financial year.

Meanwhile, former Murang’a Governor Mwangi wa Iria and nine others will continue defending themselves at the Milimani Anti-Corruption Court yesterday and today over allegations of conspiracy to commit corruption and abuse of office.

The case revolves around the alleged unlawful award of a KSh351.1 million media buying services contract to Top Image Media Consultants Limited by the Murang’a County Government.

In another major case before the same court, Amos Kabue Mwangi and 11 others are facing hearings from yesterday to Thursday over allegations of fraudulent payments amounting to KSh201.1 million by the Kenya School of Law.

The accused persons are alleged to have facilitated payments to companies that neither supplied goods nor rendered services.

Elsewhere, Garissa Municipal Manager Ismail Said Maalim will appear before the Anti-Corruption Court in Garissa on Thursday over allegations of abuse of office linked to the irregular leasing of land belonging to the State Department of Housing and Urban Development.

Huruma Ward MCA Peter Owera Oluoch will appear before the Milimani Anti-Corruption Court tomorrow and Thursday over allegations of forgery, false declaration and providing false information to a public body.

The MCA is accused of falsely claiming to possess a Diploma certificate from the Kenya Polytechnic and allegedly embossing a forged stamp on a self-declaration form.

Former Independent Electoral and Boundaries Commission (IEBC) employee George Kipyatich Kibor will also appear before the Milimani Anti-Corruption Court tomorrow and Friday facing charges of forgery and uttering a false document.

Prosecutors allege that he used a forged Bachelor of Business Management degree certificate in Finance and Banking to seek promotion at the electoral commission.

Yesterday, former Kenya Medical Training College (KMTC) employee Elijah Kirethi Muthoga appeared in court over allegations of fraudulent acquisition of public property, forgery and presentation of a false certificate.

The EACC claims he secured employment at KMTC using a forged KCSE certificate.

In Kakamega, Macdonald Lijoodi Makaka and Wilson Gacanja are scheduled to appear before the Environment and Land Court tomorrow in a suit seeking recovery of public land known as Kakamega Municipality Block III/212, which the anti-graft agency says was illegally allocated.

Meanwhile, Kenya Re Managing Director Johnson Jackson Githaka and Finance Manager Faustin Kinyua will appear before the Makadara Law Courts on Friday for mention of a case involving the alleged fraudulent acquisition of KSh12.1 million in public funds.

The flurry of hearings, judgements and mentions underscores the EACC’s sustained crackdown on corruption, abuse of office, fraudulent academic qualifications and irregular acquisition of public resources within national and county governments.
