IEBC COMMISSIONERS CHERERA AND MASIT FAIL TO APPEAR BEFORE JLAC AS SCHEDULED

The Departmental Committee on Justice and Legal Affairs that is mandated to hear the four petitions against 4 Independent commissioners of the Electoral and Bounderies Commission (IEBC) had scheduled hearings yesterday from IEBC Vice Chairperson Juliana Cherera and Commissioner Irene Masit.
However, the two commissioners failed to appear before the committee as expected.
Ms. Cherera who did not appear before the committee, was represented by her Lawyer, Apollo Mboya who presented an appeal to the committee for adjournment of the sittings by 10 days so as to allow her ample time to respond to the petitions seeking her removal from office.
The committee chairperson, George Gitonga Murugara while responding to the application, declined the request to adjourn for 10 days, citing time constraints in the legislative process.
“This committee is inclined to grant adjournment however it is not along the terms asked for but according to terms considered as fair by the Committee,” Gitonga said.
He added; “Hearing of this matter will proceed tomorrow (today).”
IEBC Commissioner Irene Masit was expected to appear before the committee at 2:30pm but the Chairperson of committee stated that he had received a writte communication from Ms. Masit’s legal representative, Donald Kipkorir.
The letter stated that Ms. Masit is not in agreement with the committee’s ruling on the matter regarding whether the committee has jurisdiction to hear the case. Therefore the client and legal team had resolved to pursue remedies before the constitutional court.
“IEBC Commissioner, Irene Masit has the option to present a submission in writing before close of business tomorrow, November 29, 2022 at 6:00p.m. The hearing scheduled for this afternoon is hereby confirmed to be complete,” said Murugara.
