Angry residents of Kajiado County have protested against an official of the Ministry of Lands, who they claim has been working in cahoots with unknown persons to grab land from members of the community.
The residents, through a letter sent to the Ethics and Anticorruption Commission (EACC) registered complaint against Bernard Leitich accusing the former Lands Registrar at Kajiado County of facilitating the fraudulent sale of land within Kajiado and Nairobi Counties.
“That the said officer has facilitated fraudulent sale of land within Kajiado and Nairobi counties as detailed below; he facilitated the fraudulent partition of 100-acre piece of public utility land at Lorngosua area of Il Bisil, Kajiado into two plots and sold them. The parcels are Kajiado /Lorngosua/10626 and Kajiado/Lorngosua/1026,” wrote the residents.
According to the angry residents, the official transferred Everlin Naitiira’s two parcels of land illegally, and only returned them upon pressure from the commnbmity. They noted the parcels returned as Kajiado/Kaputie North 94965 and 94966.
They are also claiming that he sold Nairobi Blocks 374 and 375 each totaling 0.063 in the Donholm area of Nairobi.
“In order to try and cover the trace of his criminal activities, Mr Leitich’s trick is to subdivide the land parcels he targets and register them under new LR numbers.”
“I would like to further state that even after his transfer to Nairobi three months ago he has not moved and continues with fraudulent and abuse of office activities unabated,” claims the residents.
The residents also said in their protest letter that the rogue officer has been using proxies, who they named James Gakuya Iguanya (for the Lorngosua parcels) and Forhomes Ltd (for the Donholm properties valued at Sh100 million) for his fraudulent activities.
In a letter copied to the Director of Criminal Investigators, the Inspector General of Police, Chief Land Registrar, National Land Commission and Cabinet Secretary forLands, they demand that the matter be addressed with immediate effect.
This is not the first complaint filed against such officials, who have been taking advantage of their position to forcefully rob residents of their land and properties.
Last year, a human rights activist wrote to the Head of Public Service Felix Koskei over what he termed as an abuse of office at a key department in the Ministry of Lands.
In a letter dated October 19, 2023, Aggrey Wafula claimed that a senior official at the Ministry, in a clear abuse of power and with intent to defraud the ministry on the project known as change management system (Ardhi sasa) sponsored by FAO has nebulously acted and/or falsified records.
“Particulars of fraud/falsification are as follows: an officer who retired on 1-1-2023 is purported to have attended a seminar and paid a per diem. Another official is also listed to have attended the seminar and also paid per diem,” the letter reads in part.
